He was answering a question on behalf of the Minister of Education Dr Nyan Gadsby Dolly on the rational for the decisions by the TSC to cease the acceptance of unsolicited teachers’ application effective September 30.

Rambharat said, “The Teaching Service Commission is a constitutionally independent body charged with the responsibility under Section 125 constitution.”

He quoted Section 125 which highlighted that, “Subject to the provisions of the constitution, the power to appoint persons, hold or act in public offices in the teaching service established under the Education Act including power to make appointment of promotions, transfers and to confirm appointments to remove and exercise control over persons holding or acting in such offices, and to enforce standards of conduct on such officers.”

Rambharat said, “The decisions and questions relating to teacher recruitment should be properly directed to the Teaching Service Commission under whose remit this matter falls. The Ministry of Education is not a position to presume what the response is.

“The announcement will not be made by the MOE because the issue falls within the constitutional power of the teaching service, “the minister added.

He added that the commission will deal with the matter as it relates to recruitment.

In referring to a comment in today’s daily newspaper, Mark asked Rambharat whether he was aware of that that Gadsby-Dolly told said that the public could not submit applications for teaching jobs effective from September 30 rather than the teaching service.

Rambharat said, “The MOE having been given that information in the public domain was entirely okay, for the minister to reflect the decision of the teaching service. However, the process, the decision and decision-making is in the remit of the Teaching Service Commission.”
